1. Acceptance of Terms

By downloading, accessing and using GlucoScan AI ("Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any term, do not use the Application.

These Terms apply to all users, including browsers, registered users, and trial version users.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable, and non-assignable license to use the Application solely for your personal, non-commercial use, in compliance with these Terms and the Privacy Policy.

You may not:

• Sublicense, sell, rent, lease, transfer, assign, or otherwise exploit the Application
• Use the Application for commercial services
• Distribute or publish the Application without permission

4. Limitation of Liability

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE ASSUME NO RESPONSIBILITY FOR:

• Injuries, illnesses, or health damage resulting from use or misuse of the Application
• Errors, inaccuracies, or omissions in dose, glucose, or carbohydrate calculations
• Medical decisions made based on app recommendations or suggestions
• Changes to your treatment or medication based on app information
• Loss or corruption of data
• Service interruption or application unavailability
• Unauthorized access to your data (except for our gross negligence)
• Indirect, incidental, special, consequential, or exemplary damages
• Loss of profits, revenue, or data

IN NO EVENT SHALL WE BE LIABLE FOR AMOUNTS EXCEEDING WHAT YOU PAID (IF APPLICABLE) OR $1 USD.

5. Use Restrictions

You may not use the Application for:

• Illegal or unauthorized purposes
• Violating laws in your jurisdiction
• Infringing on third-party rights
• Harassment, threats, abuse, or defamation
• Spam, unsolicited mail, or multiple requests
• Unauthorized bots, scrapers, or automation tools
• Accessing or attempting to access other users' data
• Interfering with or disrupting application servers or networks
• Copying, modifying, or creating derivative works without permission
• Selling, distributing, or sharing access to the Application
• Reverse engineering code
• Bypassing security or authentication measures

6. User Content

You are responsible for all content you upload to the Application, including:

• Food images and photos
• Personal health data
• Medical information
• Profiles and settings

By uploading content, you grant GlucoScan AI a worldwide, non-exclusive, royalty-free license to use that content solely for:

• Providing the service
• Improving the Application through machine learning
• Analytics and research (anonymized data)

We maintain your privacy: Your content will not be shared with third parties without your explicit consent.

7. Changes to Application

We reserve the right to modify, suspend, or discontinue the Application or any of its features at any time, with or without prior notice.

We are not responsible for:

• Changes to the Application
• Service suspension or discontinuation
• Feature or content modification

8. Access Model and Pro Subscription (Consent or Pay)

Conditions of access to the application: The use of GlucoScan AI is subject to the active acceptance of one of the two funding models that sustain the service. By using the application, you agree that continued access is conditional upon:

• (i) Granting your express consent for the processing of personal data for personalized advertising through the IAB TCF v2.2 / Google UMP form, allowing the free version to be financially sustained via Google AdMob; or
• (ii) In the absence of such consent, maintaining an active and current "GlucoScan Pro" paid subscription via Apple App Store or Google Play.

GlucoScan AI reserves the right to restrict access to the application for users without an active subscription who reject the advertising model, by means of a consent gate. This restriction complies with EDPB Opinion 08/2024 on "Consent or Pay" models and with Apple App Store guidelines 5.1.1 and 3.1.2 by offering a tracking-free paid alternative.

Medical equivalence: The main medical-educational features are identical in both options; the Pro subscription only adds complementary benefits (no ads, larger analysis quota, extended history) and exempts the user from advertising tracking.

8.1 Subscription Details

• Pro Access: Unlocks all advanced features and unlimited usage.
• Payment Management: Subscriptions are managed through RevenueCat and billed via App Store (Apple) or Google Play.
• Monthly Billing: Payment will be charged to your account upon confirmation of purchase.
• Automatic Renewal: Renews automatically unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You can manage and cancel your subscription in your Apple or Google account settings at any time.

8.2 Pricing and Billing

• Price subject to change with 30-day notice
• Taxes will be added according to your jurisdiction
• Invoices are provided through the store (App Store or Google Play)

8.3 Automatic Renewal

• Your subscription automatically renews at the end of each period
• You will be charged according to your registered payment method
• Renewal occurs 24 hours before the end of the current period

8.4 Cancellation

• How to Cancel: Go to Device Settings → [App Store or Google Play] → Subscriptions → GlucoScan Pro → Cancel
• Effectiveness: Cancellation is effective at the end of the current billing period
• Refunds: No refunds for completed periods
• Reactivation: You can reactivate your subscription at any time

10. Changes to These Terms

Continued use of the Application after changes means your acceptance of the updated Terms. If you do not accept the changes, stop using the Application.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of your country of residence, without regard to conflicts of law.

For users in the European Union: Any dispute shall be resolved in accordance with the law of your country of residence.

12. Additional Privacy Rights (GDPR/CCPA)

If you reside in the European Union, California, or another jurisdiction with data protection regulations, you have additional rights:

• Right of Access: Request a copy of your data
• Right of Rectification: Correct inaccurate information
• Right to be Forgotten: Request deletion of your data
• Right to Restrict: Limit how we use your data
• Right to Portability: Receive your data in transferable format
• Right to Object: Oppose certain processing

13. Final Provisions

If any provision of these Terms is found invalid, the remaining provisions shall remain valid.

These Terms and the Privacy Policy constitute the entire agreement between you and GlucoScan AI, superseding all prior agreements.

13.3 Waiver

Failure to enforce any right under these Terms does not constitute a waiver of that right.
